Subject: Airport Link - Wooloowin Worksite Modification Request for Project Change - Questions Dear David, I am writing on behalf of the Kalinga Wooloowin Residents Association Inc (KWRA) and I have a few questions I hope you (as CEO of City North Infrastructure) will answer for me on behalf of the Wooloowin community. The Wooloowin Worksite Modification Request for Project Change (2009) document has the City North Infrastructure (CNI) logo across the front cover. 1. Was this document produced by CNI? In our opinion BrisConnections and their contractor Thiess John Holland (TJH) did know, or ought to have known that the soil formation was troublesome prior to tender allocation as the information was contained in a number of reports pertaining to Airport Link. 2. As the SPONSOR/SPV/PRIVATE-PARTY in this Airport Link project was CNI informed of troublesome soil conditions by BrisConnections (OPERATOR) or TJH (DESIGN & CONSTRUCTION CONTRACTOR) prior to tender selection? 3. When was CNI made aware of the troublesome soil conditions? 4. What measures were taken by CNI to ensure the OPERATOR / DESIGN & CONSTRUCTION CONTRACTOR had performed sufficient geotechnical analysis? 5. For this issue with inappropriate soil conditions, what time and cost mitigation strategies were presented by the selected OPERATOR / DESIGN & CONSTRUCTION CONTRACTOR prior to successful selection as preferred bidder? 6. How long has the Rose St site been considered as option should problems arise? 7. Was the Rose Street site ever listed within the PROJECT AGREEMENT as a possible mitigation measure? Most correspondence with CNI by members of the KWRA has met with no reply. At first blush this appears to be a highly effective strategy as it keeps the community uninformed during the course of a sensitive, time pressured ruling where relevant information might affect the ruling against CNI. 8. Have you explicitly informed CNI staff not to liaise with members of the community? In not, how do you explain the virtual silence from CNI to highly relevant requests from the community? The principal contract in a public private partnership project is the PROJECT AGREEMENT. The PROJECT AGREEMENT governs the relationship between government and the private party from financial close, through the design and construction phases to the expiry of the term. 9. Would you please provide us with a copy of the PROJECT AGREEMENT, including Risk Registers, mitigation measures, etc. More recently specific requests have been made to the Department of Main Roads regarding activity at the proposed Rose St site. These requests have been forwarded to CNI. No response has been received from CNI. 10. Have you received any such requests? If so, why have we not received a response? 11. Would you provide a list of properties within a 100 metres radius of the proposed Rose St site or Melrose Park which CNI has requested from Main Roads or any other Government departments? 12. Would you please explain why the owners of the block opposite the proposed site were offered $5000 in relation to surrendering their underground rights? In regards to your Board of Directors, could you please confirm whether 13. Paul Low is the Department of Infrastructure and Planning's representative on the Board of Directors for City North Infrastructure? And is Paul Low the Deputy Director General at the Department of Infrastructure and Planning? If this is not the case who is the Department of Infrastructure and Planning's representative on the Board of Directors for City North Infrastructure?
