Dear David, REQUEST FOR A COPY OF BORE LOGS - AIRPORT LINK PROJECT Thank you for your letter dated 11 August 2009 in response to an RTI application for Bore Log APL06 which was believed to be held by City North Infrastructure as the PRIVATE-PARTY in the Airport Link Project. Your letter indicates the Bore Log APL06 is not held by CNI. Let is be noted it has taken 14 elapsed days from the initial RTI application until receipt of your letter. Could you please provide answers to the following questions: 1. Has CNI ever held Bore Log APL06 or copies. If so what dates was the Bore Log APL06 held? 2. Does TJH hold the original or a copy of the Bore Log APL06? 3. Does BrisConnections hold the original or a copy of the Bore Log APL06? 4. Does Brisbane City Council hold the original or a copy of the Bore Log APL06? 5. Does Bore Log APL06 form part of the PROJECT AGREEMENT for Airport Link? Your letter states TJH have been contacted to request they assist with our enquiries and that TJH have offered to provide us with a technical briefing on the matters discovered by undertaking the bore investigation. Let it be be known Brian Nally a Wooloowin Resident met with representatives from TJH and BrisConnections in early July at such a briefing. Brian was unconvinced by the briefing and requested a copy of Bore Log APL06 for independent review. His request was declined. This meeting was the initial catalyst for the request to CNI for the Bore Log. We are interested in an independent technical briefing on Bore Log APL06. Your letter reaffirms your position that CNI is not subject to the right to information legislation. Our understanding is CNI are incorporated as a Government Owned Corporation. To the layperson CNI, as a GOC, is fully owned, directed and funded by State Government bodies who are themselves all subject to the RTI Act 2009. The reasonable person might expect as a result of this that CNI would or should be subject to the RTI Act 2009. Have you confirmed your position in relation to the RTI Act 2009 with the Office of the Information Commissioner in regard to the letter regarding Bore Log APL06? Especially in light of the request originating from members of the community whose lives will be directly affected by conclusions and decisions underpinned by this information. Again, as the PRIVATE-PARTY in the Airport Link Project which touts Community Consultation one might expect CNI to provide a straight forward and timely answer such as: "TJH have the Bore Log, I have requested they forward it to you." Your letter indicates CNI is committed to assisting us with our enquiries. Could you please elaborate and clarify this statement. Community experience from our group and others is that CNI lack transparency, timeliness and probity on the Airport Link project. We believe the onus is on CNI to demonstrate its commitment to these items - something which clearly has not happened to date. Given the imminent decision from the Coordinator General regarding the proposed Wooloowin Worksite Modification Request for Project Change I would ask you to please respond to the above 5 numbered questions and the RTI question in a timely fashion.
