Attn: David Lynch 7 October 2009 CEO City North Infrastructure Level 30, Comalco Place 12 Creek Street Brisbane Q 4000 Subject: BrisConnections Early Delivery Tolling Profit David, Hi. I am writing to you to obtain clarification of your understanding of tolling profits for BrisConnections should the Airport Link project be delivered early. In the Project Deed documentation for the Airport Link project, available on the City North Infrastucture website "the State" party is defined as: "The State of Queensland c/- The Chief Executive Officer, City North Infrastructure Pty Ltd, Level 30 Comalco Place, 12 Creek Street, Brisbane, Queensland 4000 ("the State"). As CEO of City North Infrastructure representing the State Government I anticipate you have a firm grasp of all issues and ramifications surrounding possible early project delivery. I would like to draw your attention to financial modelling, based on the BrisConnections Product Disclosure Statement (PDS), 24 June 2008, which indicates BrisConnections would be eligible for an additional $12 Million profit for each month they deliver the project earlier than the Airport Link project deadline of June 2012. This figure is based on projected traffic flows and planned toll rates contained in the PDS. I have a single question for you: "Could you please elucidate your understanding of the figure BrisConnections will obtain through tolling profits for any early delivery of the project?" * A monthly figure rounded to the nearest $ Million would suffice. I understand BrisConnections may have more detailed information. This is not the information I am after. I am after your understanding in the position as CEO of City North Infrastructure.
